Terms of Service

Vivid Moments ("we", "us") turns photographs into short cinematic videos. There are two entirely different ways to get one, and these Terms cover both:

• We make it for you — the done-for-you gift service. You send us photographs and a brief, we make the video by hand, and we deliver it by an agreed date. Governed by Part A.
• You make it yourself — the self-serve editor. You upload your own photographs and our software generates the transitions on the spot, with no one from our team involved. Governed by Part B.

Part C applies to both. Where a section sits in Part A it says nothing about the editor, and where it sits in Part B it takes nothing away from the promises we make to gift customers in Part A. If the two ever appear to conflict, the Part that matches what you actually paid for wins.

You must be at least 18 years old to place an order or to buy tokens. By doing either you confirm that you are.

We sell a finished video, not access to software. You send us photographs and a short brief; a member of our team sequences the photos, directs the transitions between them, selects music, reviews the result, and edits a final cut. We deliver it as a private link and a downloadable file.

A standard order includes:

• A finished video up to 1 minute long, made from up to 20 photographs you send us. Roughly 12 photographs fill the full minute; where you send more, we select the strongest rather than making the video longer.
• Widescreen, vertical and square versions of the finished video
• A private share link and an MP4 download
• 1 round of changes, as described in Section 6

None of this applies to the self-serve editor, which is not a service we perform for you and carries no delivery promise. See Part B.

Submitting the order form is a request, not a completed purchase, and it does not oblige you to pay anything. The sequence is:

• You submit the order form with your brief, your photographs, and the date you need the video by.
• We review them and tell you honestly whether they will make a good video. If we do not think they will, we say so and you owe us nothing.
• If we can do the job, we confirm your delivery date in writing and send you a secure payment link.
• A contract is formed, and production begins, only when your payment completes. Your delivery window starts at that moment.

We may decline any order at our discretion — for example if the photographs are unsuitable, the deadline is not achievable, or the request falls foul of Section 10. Declining costs you nothing.

The standard price for a done-for-you video is $50 USD. The price for your order is the one stated in the payment link we send you, and it will not change afterwards. Tokens for the self-serve editor are priced separately and are covered by Section 8.

• Payment processing: handled by Stripe, Inc. We never see, store, or have access to your card details.
• Currency: prices are in US Dollars. Your bank may apply conversion fees we have no control over.
• Taxes: prices exclude any sales, use, VAT, or similar tax. Where we are required to collect such tax, it will be shown before you pay.

We deliver within 2 days of payment clearing, or by the specific date we confirmed to you in writing, whichever we agreed. We treat that date as a promise, because a gift that arrives after the occasion is worthless.

5.1 If we miss the date

If we fail to deliver by the confirmed date, you are entitled to a full refund, on request, whether or not you also accept the finished video. You do not need to give a reason and we will not ask you to argue for it.

5.2 Delays caused by missing information

The clock starts when we have both your payment and everything we need to do the work. If we ask you a question that blocks production and you do not reply, the delivery date moves by the length of that delay. We will tell you if that happens rather than letting the date slip silently.

5.3 Events outside our control

If delivery is prevented by something genuinely outside our control, we will contact you promptly with the choice of a new date or a full refund.

6.1 Included changes

1 round of changes is included. A round means one consolidated set of notes — reordering photos, swapping a photo, redoing transitions you do not like, or changing the music. Requesting changes does not extend the original delivery date unless the request is substantial, in which case we will agree a new date with you.

6.2 If you are still not happy

If the video is still not right after your included round of changes, tell us and we will refund you in full. We would rather refund you than have you give a gift you are not proud of.

6.3 Cancelling

You may cancel for a full refund at any point before we begin production. Once production has begun, Section 6.2 and Section 5.1 are the routes to a refund.

6.4 Consumers in the EU and UK

Every video we make is created to your specification and is clearly personalised to you. Under Article 16(c) of Directive 2011/83/EU and the equivalent UK Consumer Contracts Regulations, the 14-day right of withdrawal does not apply to goods and content of this kind.

Before you pay, we ask you to expressly consent to us beginning work immediately and to acknowledge that you thereby lose your right to withdraw. If you are not asked for that acknowledgement, or you do not give it, your statutory right of withdrawal is unaffected and survives these Terms. Nothing here limits your statutory rights where the video is faulty, not as described, or not delivered.

Our own promises in Sections 5.1 and 6.2 are deliberately more generous than the law requires, and you may rely on them instead.

The editor is software you operate, not a service we perform. You upload photographs, our system generates the motion between them, and you get the result as it comes out. Nobody on our team chooses your photos, directs the transitions, reviews the output, or fixes what you do not like — that is the difference you are trading for the price.

7.1 Using it without an account

You can use the editor without signing in. An anonymous session is identified by a cookie, is provisioned one free token, and produces a watermarked video that we delete 24 hours after it is generated.

7.2 Signing in

Downloading a video, sharing it, and buying tokens require you to sign in with Google. Signing in promotes your anonymous session to an account and keeps the work you have already done. You are responsible for the security of the Google account you use; tell us at once if you think someone else has access to it.

7.3 Availability

The editor is provided as is and as available. We do not promise it will be uninterrupted or error-free, and we may change, suspend, or withdraw it. If we withdraw it permanently we will refund any unused tokens you have paid for — see Section 8.3. Nothing in this section affects a done-for-you order you have already paid for.

8.1 What a token is

The editor runs on tokens. One token generates one transition between two adjacent photographs, so a video made from n photographs costs n − 1 tokens, up to a limit of 20 photographs per video. New sessions get one free token. Tokens are a limited licence to use the editor, not property, not currency, and not transferable between accounts.

8.2 Buying tokens

• Payment processing: handled by Stripe, Inc., exactly as in Section 4. We never see or store your card details.
• No expiry: purchased tokens stay in your account until you spend them. We will not quietly expire them.
• Currency and taxes: as set out in Section 4.

8.3 Refunds

Unused tokens: email us within 14 days of purchase and we will refund any tokens in that package you have not spent. You do not need to give a reason.

Spent tokens: a spent token has bought you a generation that we actually ran and paid for, so it is not refundable simply because you dislike the result — reviewing the output is your job in the editor, not ours. If a token is spent and you receive nothing because of a fault on our side, tell us and we will put the token back or refund it.

The generous remedies in Sections 5.1 and 6.2 belong to the done-for-you service. They do not apply to the editor, because we are not the ones making the video.

8.4 Consumers in the EU and UK

Tokens are digital content supplied immediately. When you buy them you ask us to make them available at once and acknowledge that, to the extent you spend them, you lose the 14-day right of withdrawal for the content supplied. Your right of withdrawal over any tokens you have not spent is unaffected, and Section 8.3 gives you that refund anyway. Nothing here limits your statutory rights where the editor is faulty or not as described.

You agree not to:

• Tamper with, reverse-engineer, or work around the token system, the API, or any other security measure — including manipulating token balances or upload limits from the client;
• Create multiple sessions or accounts to harvest additional free tokens;
• Use bots, scrapers, or automated tools against the editor without our written consent;
• Do anything that could damage, overload, or degrade the service for other people.

We may suspend or close an account that breaks this section or Section 10.3. Where we do that for genuine abuse, unused tokens are forfeited; where we get it wrong, tell us and we will put it right.

10.1 You keep ownership

You keep full ownership of every photograph you send us. You grant us a limited, non-exclusive, royalty-free licence to store, process, edit, and transform those photographs solely to produce and deliver your order, or to run the generation you asked the editor for. That licence ends when we delete your files under Section 12.

10.2 What you promise us

Most of these videos are gifts, so the photographs usually show someone other than you. That is expected. Whether you send photographs to us with an order or upload them to the editor yourself, you confirm that:

• They are yours to use, or you otherwise have the right to use them;
• The people shown would be comfortable appearing in a video made from them, and you have their agreement where they would reasonably expect to be asked;
• Where anyone shown is a child, you are their parent or guardian or you have that person's permission;
• Using them does not infringe anyone's privacy, publicity, or copyright.

If someone shown in your photographs asks us to delete them, we will, and we will tell you that we have.

10.3 What we will not accept

We will decline any order, and remove any upload, involving material that — and where the law requires it, we will report it:

• Sexualises, exploits, or endangers a child in any way;
• Was obtained without the knowledge of the person shown;
• Is intended to harass, defame, deceive, or impersonate anyone;
• Infringes a third party's intellectual property;
• Is unlawful in any jurisdiction relevant to the order.

10.4 Showing your video to others

We do not use your video or your photographs to promote our business unless you separately and explicitly say we may. Agreeing to these Terms does not give us that permission. If we would like to use your video as an example, we will ask you in a specific request that you are free to decline, and declining has no effect on your order, your price, your delivery date, or your access to the editor. Any permission you give can be withdrawn at any time by emailing us. This is equally true of videos you make yourself.

Both routes use the same artificial intelligence to generate the motion between your photographs. That is what makes the transitions look cinematic instead of like a slideshow. The difference is who reviews the result.

In a done-for-you order, a person on our team decides the order, writes the direction for each transition, reviews every generated segment, regenerates the ones that fail, and assembles the final cut. AI output is not fully predictable — generated motion may occasionally distort a face or look unnatural — and catching that is our job, not yours. Anything we are not happy with does not ship.

In the editor, there is no such review. You see what the model produced, including its mistakes, and deciding whether it is good enough is yours to do. You can spend another token to regenerate a transition you do not like.

You own the finished video and may use it however you like, including publicly. We claim no ownership over it. We cannot guarantee that AI-generated imagery is free of every possible third-party claim, and we do not warrant it as suitable for commercial advertising use.

Done-for-you orders:

Your photographs

Kept while we produce your order and for 30 days after delivery, so that changes are still possible, then deleted.

Your finished video

Available at your private link for 90 days after delivery. Download it — that copy is yours permanently.

Order records

Your brief and correspondence are kept as long as needed to run the business and meet tax and accounting obligations.

The self-serve editor keeps things for much shorter, so download anything you want to keep:

Photographs you upload

Deleted 30 days after upload, on each file's own clock.

Videos made without signing in

Watermarked, and deleted 24 hours after they are generated.

Videos made while signed in

Deleted 7 days after they are generated.

Your account

Kept until you ask us to close it. Email us and we will delete it and anything left in it.

Want your photographs deleted sooner? Email us and we will do it, usually the same day. Details are in our Privacy Policy, which forms part of these Terms.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, your statutory rights are unaffected by this section.

Subject to that, and taking the two offers in turn:

Done-for-you orders. We are responsible for delivering the video you ordered, on time, to a reasonable standard. We are not responsible for indirect or consequential losses — for example the value of an occasion, travel costs, or event expenses — and our total liability for any order will not exceed the amount you paid for that order.

The self-serve editor. It is provided as is. To the fullest extent the law allows, and except where you are a consumer and the law says otherwise, we give no warranty that it will be uninterrupted, error-free, or fit for any particular purpose, and our total liability arising from your use of it will not exceed the greater of what you paid us for tokens in the 12 months before the claim or $10 USD. This lower cap applies only to the editor and never to a paid order under Part A.

Either way, keep your own copies of the photographs you send or upload. We are not a backup service and are not liable for loss of your originals.

If something goes wrong with an order or with the editor, email us first — nearly everything is resolved that way, and our refund policy is deliberately broad enough that formal disputes should be rare.

These Terms are governed by the laws of the State of California, USA, and the courts of that state have non-exclusive jurisdiction. If you are a consumer resident in the European Union or the United Kingdom, you keep the protection of the mandatory consumer laws of your country of residence, and you may bring proceedings there.

We may update these Terms. The version that applies to your order, or to a token package you have bought, is the version published when you paid — we will not change the deal after you have bought. For continued use of the editor, the current version applies. Material changes will be noted by the "Last Updated" date above.

• Entire agreement: these Terms and the Privacy Policy are the whole agreement between us about your order and about your use of the editor.
• Severability: if any part is unenforceable, the rest continues to apply.
• Waiver: not enforcing a right once does not waive it.
